Terms and Conditions

  1. Customer represents that they are an individual trader who will only use the Licensed Software to trade their personal and/or
    a family account. For these purposes, a personal or family account is one in the name of the customer, or one in the name of the customer's spouse, children, close relative, or related family trust.
  2. The customer agrees they will notify ADTS Systems immediately if he is managing money, trading for others, or becomes a competitor directly or indirectly or offering trading-related products or advice. A new annual and renewal license fee is required for each person the customer trades for, advises, shares signals, or directly or indirectly in any form benefits from ADTS Systems software or intellectual property. If the customer trades for a private entity, such as a group of investors or fund, then license fees will apply. ADTS Systems reserves the right to terminate any licensing agreement in which the customer violates any terms of this agreement. ADTS Systems Software License is for one year, then the annual renewal fee applies as stated on ADTS Systems website. Unless agreed otherwise, the license is for one computer and is non-transferable to another party or entity.
  3. Customer acknowledges that they may not broadcast signals, use ADTS Systems software commercially, rent or share ADTS Systems software, trade secrets, manuals, training videos, or assign, sublicense, transfer, pledge, or lease ADTS Systems software or intellectual property to others unless agreed upon with ADTS Systems' specific written consent; any violation will result in immediate license termination.
  4. Customer acknowledges that ADTS Systems developed the trading algorithms, strategies, or indicators and hereby grants Customer a limited, non-exclusive, non-transferable license to use the ADTS Systems software and intellectual property referred to as "ADTS Systems Software" (below) for personal or family trading only, unless otherwise agreed upon in writing.
  5. The customer acknowledges the ADTS Systems software shall be utilized by the customer only in accordance with these Terms and Conditions and shall not be copied into any other software (including any source code, object code, or algorithms), modified, or disclosed in any form by any media to any other person or party.
  6. Customer acknowledges ADTS Systems shall not be liable to Customer for any loss, cost, damage, technical problems, system failures or malfunctions, acts of God, market events, fast markets, pandemics, electronic risk, internet outages, communication failures, equipment or software failures and malfunctions, or any computer problems or defects, and that ADTS Systems software is provided "as is."
  7. The customer acknowledges that trading and speculation in futures, commodities, and the like, including online trading, entails a high risk of financial loss, and that any decisions to trade and speculate in free markets are the customer's own and sole responsibility. The customer understands and acknowledges that ADTS Systems does not guarantee or imply that the customer will achieve the same or similar results or profits as depicted in any video, marketing material, ADTS Systems website descriptions, pictures, communications, or performance, whether live, simulated, or hypothetical, and that past results are not necessarily indicative of future results.
  8. Customer acknowledges that they will not seek to hold ADTS Systems liable for any loss caused by Customer's use of ADTS Systems software or its content, whether in contract or tort. While ADTS Systems software may generate signals, it does not constitute a recommendation to buy or sell securities. The customer agrees that any decision to use ADTS Systems software or to buy or sell securities is ultimately determined by the customer's own analysis and decisions.
  9. The customer acknowledges and understands that ADTS Systems software is a trading tool and not a "bot" that runs unsupervised. ADTS Systems software does not imply, guarantee, or suggest that using it will result in profits or match the profits of others, historical backtesting, or other profit projections. The customer agrees and acknowledges that the risks associated with online and electronic trading, such as internet outages, unfilled orders, and other errors, are beyond the scope and control of ADTS Systems software. The customer understands and accepts full responsibility for his own trading decisions, including the decision to trade using ADTS Systems software.
  10. Customer acknowledges, agrees, and accepts that these Terms and Conditions accurately represent and describe what ADTS Systems software is and is not, and that these Terms and Conditions describe the majority, but not all, of the risks associated with the ADTS Systems software.
